§ 17-16A. Sentencing/municipal court.

  • (a)

    A violation of any of the provisions of the Cortez City Code/City Ordinances is punishable by a fine of up to four hundred ninety-nine dollars, a jail sentence of up to one hundred eighty days or by both a fine and jail sentence, except as set forth below or at Cortez City Code section 17-10, right to jury trial, section 18B-9, juvenile sentencing and section 16-4, Model Traffic Code.

    (b)

    Unless otherwise indicated each day or portion thereof any violation of any provision of the Cortez City Code/City Ordinances shall continue shall constitute a separate offense.

    (c)

    Unpaid fines and costs may be collected by the court as set forth in C.R.S. 13-10-114 and 18-1.3-506 C.R.S. now in effect or as may be amended from time to time. Unpaid fines and court costs in appropriate circumstances may be collected as set forth/pursuant to § 31-20-105 C.R.S. and certified to the Montezuma County Treasurer for collection in the same manner taxes are collected.

    (d)

    In addition to fines or a jail sentence, the court may approve deferred judgment and sentencing for a period of time of up to one year, unsupervised probation of up to one year, a deferred prosecution for up to one year, or suspend jail or fines, contingent upon such terms and conditions including payment of restitution as the court finds appropriate.

    (e)

    Juveniles shall not be sentenced to jail as a result of a conviction of the Cortez City Code/City Ordinances. Juveniles shall be sentenced as set forth in Cortez City Code section 18B-9, juvenile sentencing, now in effect or as may be amended from time to time.
